Wanda07_16_04.jpg

Life imitating art for todays picture. A couple weeks ago we were hanging out with a few friends tossing back beers and just having a good time. Somebody had a beer from a local micro brewery who's labeling we locals find humorous. A few years ago the Brewery came out with "St. Provo Girl" beer. Well of course they got sued by st. Pauli Girl Beer and had to lose the "St." part of their name as well as change the outfit the girl on the label was wearing. Too bad, it was a great parody especially the "Saint" part.

Anyway, someone thought we should replicate the new label on the Provo Girl Beer. Well Wanda is from Provo; so, it made sense. Here is our attempt to do the image which was no easy task. Trying to get the perspective was tough because the waterfall is well above the canyon floor where the road and parking lot are located. But we worked it out and got close.

So here is my Provo Girl.

We had intended to just "try" to get this image but ended up succeeding! It turned out way better than I thought it would cuz I was NOT in the mood! It was HOT that day and I was cranky! I was melting in the heat and once again I was feeling a bit foolish standing there in a public place where onlookers could gawk at Me. I would make Bill wait until I was certain no one was looking before I would pose for the picture. All things considered, I think it turned out GREAT!

That is what I'm hoping for too Sean. At this point I haven't had any response from Salt Lake Brewing.

BTW, my concern was mainly the claim of a copyright on the image as posted, which includes inset material you don't own. I hope they are ok with leaving the image posted, possibly with the addition of "inset image copyrighted by and trademark of ...., used with permission" or something along those lines (in unobtrusive fine print).

Wanda and I sent an email off to the company this morning. Here is a copy of the message.

"I'm an amateur photographer and have a project that I'm working on where I take a picture a day of my wife Wanda.

A few weeks ago a few of my friends and I were sitting around drinking some Provo Girl Beer. Someone said that my wife and I should try to replicate the Provo Girl label for one of our photo's. I said I didn't think it could be done because I wasn't sure we could get the same perspective as the drawing. I was wrong.

Anyway to make a long story short my wife Wanda and I did replicate the label picture. We posted it to our web gallery with the reat of our daily photos. We posted our picture with an inset of the real label to show what we had done. After posting the picture someone suggested we shouldn't post the photo because we might be infringing your copyright. That is something that really hadn't occurred to us. We're not trying to sell the picture or beer but we do want to make sure we respect your feelings. We did it as a learning exercise. And learn we did. The drawing on the label was tough to replicate in a photograph.

So here is the link to the picture.

We like the photo and would love to leave it on the gallery for the length of our year long project but if you and your comapny have a concern with it we would be willing to take it down. We would really appreciate some input."

Amazing you could pull this off so well!

Are both taken at the same spot? It is a real amazing shot.

Sean I don't think they will use mine. Wanda is pretty cute but thier model is way hot. I'll quote, from what has to be one of my favorite ads they ran for Provo Girl Pilsner "She got really nice cans."
Sean Garnett17-Jul-2004 16:11
Heck, they might want to USE your version :)
Wm. Bates17-Jul-2004 14:17
Heck, just for fun come Monday I'll contact the Salt Lake Brewing Co and see if they mind the photo being up on the web.

I'm no attorney, but I see no problem with this parody. Credit has been given to inset and there is no product for sale here that would confuse consumers or damage the reputation of the makers of the beer. (as was the claim of St. Pauli in their lawsuit) What I see here is just good old fashioned fun and it makes Me want to try one of them beers. Now who could complain about that? By the way, great shot! oh, one last comment for Sean, it would seem obvious to me that Wm.'s copyright applies to his photo, not the inset. however, perhaps it would be wise of Wm. to remove the inset and place it somewhere else so the comparison can still be made but there would be no question as to just what part of the image is copywrited.Just a thought.

Sean, This was done for strictly educational purposes and parody and is not being offered for sale. (hope that gets us past the legal department) It would be interesting to see what Squatters Brewery thinks. The original offerings of this beer was called "St. Provo Girl" and the young lady in the image had a little blue and white dress. The breweries defense in the lawsuit with St Pauli Girl was it was parody. The settled on dropping the "ST" and changing her clothes.

Now for the education part. The hardest part of duplicating the drawing was getting the perspective correct. The water fall is well above the parking lot where we did the photo. It required me laying on the ground and shooting up with a wide angle. With Wanda standing straight up the distortion made it look like she was leaning way back. To make it look like she is standing up straight she need to lean way forward toward the camera. I'm sure to the other people in the view area it looked very strange. Her pose for sure looked very unnatural.

I like it, but I'm not sure claiming a copyright on (or even "publishing") your image is strictly kosher (at least with the inset original). You are probably infringing on the brewery's copyright/trademark. Since I know you have taken infringements of YOUR copyright seriously ....

Excellent work, nevertheless.

Bill/Wanda...this one is so great. Whenever we are in Utah we bring back Polygamy Porter and St Provo Girl for friends...seeing your "copy" really put a smile on our faces. Great concept and very well executed. Love it!

Each morning I quickly check the posting you may have made to the site for that day, and love the images you both choose to share. Thank you for the inspiration to participate as well. I think the most appealing image thus far this month was the image from the salt flats. The moon, the lighting, the pose, the exposure are wonderful. Absolutely terrific!
It is so difficult to find the same or similar location and then to have the light and environmental issues comply. You did it!
Wanda 17-Jul-2004 01:28
This picture actually turned out better than I thought it would. I was NOT a happy camper during this shoot. It was HOT and Windy and I don't wear My hair in pigtails so I felt like a bit of a fool. I did My best to smile just like the girl on the label and achieve the same kind of expression, but with the wind in My eyes I couldn't help but squint a bit. All in all though, I think Bill did a damned fine job!
Dennis Steinauer17-Jul-2004 01:10
Bill, what are you doing to that woman? She seems to get younger in every photo -- and you still want us to believe she uhmhmm years old and a grandmother. I'll bet you think I bought the yellow-cake uranium, too. Great shot. Time for a beer.
Guest 17-Jul-2004 00:55
I like this. I like the effort made in details such as the red bobble/scrunchie/whatever-americans-call-hair-thingies. You ought to send it to them, she might sell more beers than the drawing!
I often can't match perspectives to my own previous shots, wouldn't fancy trying it with a picture. As a bit of processing fun, you could try making a wanda-label with the ellipse shape of the original.
Jude Marion17-Jul-2004 00:52
Very well done, Bill! This is amazing!
Wm. Bates17-Jul-2004 00:46
Richard, the amount of time really varies from day to day. On average I would guess it is about half to a full hour taking the picture. Then we spend maybe 10 minutes picking our favorite image and then another 15 minutes processing in photoshop. This one took a little longer. Some of that was drive time and some of it was waiting for light. All I can say is we spend what ever time is needed to get the job done. July 1st was a 10 hour project.
Cougar 17-Jul-2004 00:41
I hate to repeat myself, but great job!! At least to my eye, you got this pretty spot on!
Richard 17-Jul-2004 00:35
I think you did a great job! Just out of curiousity, how many hours a day do you two spend on this project?

Regards and thanks,
