Wayne County, NC - Will of Uriah Langston, 1838

In the name of God amen
I URIAH LANGSTON of the County of Wayne and State of North
Carolina do this day make and publish this to be my last will and
testament in man-ner and form following, being of a sound and desposing
mind and memory
FIRST I give my beloved wife MARY LANGSTON one bed and furniture,
one mare called Pigeon, two cows and calves her choice, two ewes and
lambs, two sows and pigs her choice,three hundred dollars in silver.
I give to EQUILLA LANGSTON five dollars.
I give to my grandson, WILLIAM LANGSTON five dollars.
I give the land where my son ELIJAH LANGSTON lived to be sold by
my executor when my grandson ELISHA LANGSTON comes in here or when
he arrives of age he the said ELISHA LANGSTON to have three hundred
fifty dollars of the money arising from the sale, the balance of the
money to be equally divided between my two grand daughters ELINOR and
ELIZABETH LANGSTON.
I give to my son ASA LANGSTON all the land on the east side of the
marshy branch, but not to have possession of the cleared land in the
life time of my wife. I give to my son HENRY LANGSTON all the land on
the west side of said branch except the land I bought of ISAAC HILL to
a small branch be-tween HENRY LANGSTON and ROBERT LANGSTON the branch
near where the old path crosses the road from here to the place I
bought of ISAAC HILL.
I give my son IRASA LANGSTON the land where IRA LANGSTON lives and
the land called the Bun land and he is to pay to ROBERT LANGSTON fifty
dollars.
I give to my son URIAH LANGSTON the land where he lives.
I give to my son ROBERT LANGSTON the land where he lives from the
branch road between him and HENRY to the branch on this side of
ROBERT'S house and from the branch at the road near ROBERT'S house from
a stake stuck at the branch and road and run an west course till it
touches LEMUEL H. WHITFIELD'S line.
I also give the land I bought of ISAAC HILL to be equally divided
between my two sons HENRY LANGSTON and ROBERT LANGSTON.
I give to my son WRIGHT LANGSTON all my lands that I have not
before given away but not to have possession of the land in the east
side of the marshy branch as long as my wife lives.
All the land I have given to my children, I give it to them and
their heirs forever.
I give to WRIGHT LANGSTON one horse called John and bed and
furniture, one bridle and saddle, one cow and calf.
I give to my daughter SALLY HOWELL four hundred and fifty dollars,
one hundred dollars to be paid out of the first money that's raised,
the balance to be paid as soon as the money can be collected after the
death of my wife.
I give to my daughter POLLY PIKE four hundred and fifty dollars,
one hundred to be paid out of the first money raised, the balance to be
paid as soon as the money can be collected after the death of my wife.
I give to my daughter MARTHA LANGSTON five hundred dollars, one
hundred dollars to be paid out of the first money raised, the balance
to be paid as soon after the death of my wife as the money can be
collected and one bed and furniture, one cow and calf or the worth of it.
I give to my daughter LYDIA LANGSTON five hundred dollars, one
hundred to be paid out of the first money raised, one bed and
furniture, one cow and calf. (missing sentence) The balance to be paid
as soon after the death of my wife as the money can be collected.
The legaces I have left in money are not to draw interest, as they
are paid at the time mentioned.
The horse I give to my son WRIGHT, if he should die by attering ?
for him (WRIGHT) to have fifty dollars paid him in money.
I leave my lot and house in WAYNESBOROUGH to be sold at my decease.
My executor (two sentences I can't figure out) something about a
stone house can't be sold until the first of October because he has it
rented until then.
The money arising from the sale to go to paying of the legaces.
I give my son ASA LANGSTON the horse called Star one bed and
furniture.
I give my grand son GEORGE LANGSTON (if he ?) stays with my wife
as long as she lives one hundred dollars one bed and furniture, part of
the money to go to schooling him.
I lend to my beloved wife all the balance of my property that I
have not given away during her natural life or widowhood. At her death
to be sold by my executor and after paying of the legaces divided among
all my heirs, except my son ELIJAH LANGSTON'S children.
I wish for my executor to sell my two Negroes TOM and FINAS
together.
I wish for my two daughters MARTHA and LYDIA to have with their
beds all the bed clothing that they call theirs.
At my decease, I wish for my executor to pay over to my daughters
all the money that is left after paying my just debts and the legace
that is to be paid then for it to go to wards paying them the balance
of their legecy that is to be paid them at my wife's death.
I wish lot and house to be sold on a credit of six months.
Lastly I nominate my two sons IRA LANGSTON and URIAH LANGSTON my
whole and sole executors to this my last will and testament, revoking
all other wills made by me heretofore, ratifying this and no other be
my last will and testament given under my hand and seal this the 26th
day of February 1835.
