August 31, 2024, more fences connected to the FHT HOA Trails fence without a joint party fence agreement. Now we have fences with privacy screening placed between the buffer lanscaping and the HOA trail. Appears to be in violation of the approved County Plans and intent of the buffering to maintaim the nature of the walking trails between developments.
Fencing Encroachment on FHT property & 30 ft Easement
Fence cuts across the new development common area for a 30' landscape buffering easement/drainage area to be maintained by the developer and enters the FHT HOA common area property ending at the FHT HOA fence. Placed so close to the FHT HOA fence that this section becomes a common "party" fence and done without HOA approval. This will close access to both FHT and the new developer or future HOA in the new development.
Trees over property lines:
Many years ago, the courts worked out rules for how each neighbor should maintain their property in a way that does not harm others while balancing each’s right to use their property as they saw fit, deciding that “a possessor of land is not liable to persons outside the land for a nuisance resulting from trees and natural vegetation growing on the land.”

Conversely, if the tree is unhealthy and damages your property, your neighbor will be held responsible for the damage it causes.
