Excellent photo, ironic positioning, brings back memories. I think the vendor is actually on the sidewalk, thus the sign does not apply to him. When my wife and I went to the City we always got a NYC Pretzel, they're the best! If it was winter we would buy some chestnuts roasted on an open fire. I may be in the Bronx this week, I wonder if I can find an NYC pretzel there? It is hard for me to type with a cat standing on my lap...
