Martins Brook DEP Appeal.jpg
The Headwaters Stream Team represented North Reading residents in an appeal/dispute over the Mean Annual High Water line of Martins Brook. This was one of the site visits. We eventually were able to agree on a line with this group of developers and negotiated with the other developers on Phase 2 of the project a 100 foot no-disturb line along the brook in perpetuity from our Mean Annual High water line. Martins Brook serves as a water supply for North Reading and Wilmington and provides important flood storage for both communities. It is also a vital resource for many riverine species and migratory birds, wood ducks in particular. We need to do a better job as a whole protecting these wetland and woodland streams. They are not being protected as the law mandates in the Rivers Protection Act due to DEP's contradictory language in the regulations.
