A Purple Finch. The bill shape, tail-length, and blurry brown streaking look a bit like House Finch but the undertail coverts lack streaking a definite Purple Finch character. The appearance of a dark ear-patch (or cheek) also suggests Purple. Also your other photo shows Purples, although both House and Purple could be on a heavily fruited barberry. It is definitely not a towhee; lots of reasons, but the tail alone is obviously wrong for towhee.
