Pine Flycatcher?

Taken under low light conditions right when it started raining 1/04 at Choke Canyon State Park. This is thought to be the first of its kind in the US.

Please do an internet search for articles on how, who, when the bird was found.

That's a fine photo - not easy to do with these little empids. You've got a lot of the needed features well documented (eye-ring, throat, bill colour, degree of grey/yellow on breast, tail notch) - be very interesting to see what the rare-bird committee thinks.
