This is a Merlin. A member of the Falcon family, just a bit larger than an American Kestrel. Note the size of the eye and that it is all one color. A cooper's hawk has an eye with a noticeable iris and pupil. Merlins, as falcons, have sharply pointed wings, unlike the broad rounded wings of Cooper's and Sharp-shinned Hawks. This is a great shot and a lucky one too, as these are not so easy to find.
