Democrats' Virginia Power Grab Faces Total Wipeout in Court

Former Virginia Attorney General Ken Cuccinelli is calling it straight: the Virginia Supreme Court is poised to unanimously strike down the sneaky redistricting amendment that Democrat lawmakers rammed through, despite voters narrowly approving it on April 21.

The scheme was a blatant attempt to hijack the state's congressional map and engineer a ridiculous 10-Democrat-to-1-Republican setup for the 2026 midterms, bypassing the bipartisan commission voters demanded years ago. But Democrats didn't follow the clear rules for changing the state constitution. They skipped required steps, played games with timing, and used misleading ballot language to fool people.

A circuit court judge in Tazewell County already slammed the brakes, blocking certification of the results and ruling the whole referendum unconstitutional. That injunction stands for now, and the case is heading straight to the state Supreme Court.

Cuccinelli points out the major procedural violations: the legislature ignored mandatory processes, including proper passage timelines and an intervening election requirement. Virginia precedent is clear—the high court treats these referendums as part of the legislative process and applies strict scrutiny. Even though voters said yes by a slim margin, the Democrats' shortcuts make the whole thing invalid.

This isn't about ignoring the "will of the people"—it's about Democrats ignoring the Constitution to rig elections in their favor. If the Supreme Court does what Cuccinelli predicts, Virginia's fair maps stay in place, and this raw power play gets tossed where it belongs: in the trash.
