Oakland Police Department Videotaping Is Illegal & Unconstitutional (1)

Why is a local law enforcement agency doing something unlawful? Do they think they are above the law or are they ignorant?? Either way, we think they should stop. Oakland Occupiers know the law better than O.P.D.? That's why they are telling them to stop videotaping. When someone is doing something wrong, they should be told so, and right that wrong. That's how most of us were brought up. Videotape surveillance by local police agencies is an infringement of First Amendment Rights. It has been argued in U.S. Federal Courts that videotaping protesters who engage in peaceful demonstrations can deter free speech through fear of reprisal from the police. Along with the video tapes are the files and dossiers that are compiled on those who are vocal and speak out. Local police agencies identify these vocal protesters as leaders and troublemakers and single them out for arrest and punishment at future demonstrations and rallies. I have witnessed B.A.R.T. police use this tactic numerous times at B.A.R.T. protests in San Francisco.
