1139. For sale?

A couple of weeks ago I took a one-hour flying lesson from Dundee airport. I took my camera with me on my adventure in the hope of capturing some familiar locations from an unusual angle: in the hope that one or two might turn out to be any good. I didn't really take that many, and even fewer that were worth the effort - I was too excited at having the opportunity to control a light aircraft 1000 feet up. Anyway, this photograph was one of the best that I managed to capture. I know it's not a wonderful photo - its value is purely in the view it contains. I work on the local newspaper here in Dundee, and every now and again I send in a picture that can be used as a filler on the local pages. When I started working here I was told that the company do not take copyright of submitted pictures, and that they are only used - when they are used at all - on a one-off basis. It should also be noted that the paper I work for does not give photo credits (and nor does it pay for unsolicited photographs). On that understanding, I allowed them to use my image. Now it transpires the company has been selling copies of the image - I don't know how many they have sold, or to whom. The sales department seem to think that because I am an employee (not employed as a photographer), then they have the right to sell my image without paying me! I'll be putting them right first thing on Monday morning. I'll let you know what they say.

uiiii..pensei que esse tipo de coisas não fosse comum fora de paises como Portugal...por aí esperava um pouco mais de respeito pelo "fotógrafo" e também pelo direitos de autor...fantástico esses teus patrões...tens a certeza que não haverá por aí influências de "outras origens" ????...lol..

Stu, good for you. It pi**es me off that some people think that great images should be free because they are photographs rather than oil on canvas. Anyway, next time you fly over North Berwick, do a barrel roll and I will wave to you !!

I posted before I looked (w/ Opanda IEXIF 2). Good for you! You've already inserted your copyright data. I'd say that if the images of yours the paper has sold have this data on them also, you have them over a legal barrel... a -pickle barrel-! :) If they've posted or used these images online, you can also find software to sniff them out no matter where they might be hidden. You're in the driver's seat.

You should immediately (if you haven't already) begin burying your copyright information in the EXIF information on all your images. I don't believe anyone can deny you ownership or rights if the photos are yours. Aside from the protection the copyright EXIF data affords you it will also be helpful if ever (God forbid) your equipment is stolen. If recovered, you can simply retrieve the data in the presence of the authorities to validate your legal ownership.
