Hershey’s lawyers have prevented Yorkie chocolate bars from being sold in the USA as they claim it infringes their ‘York’ mark used on their peppermint patty. The products are completely different in content, shape and wrapping colour.
Both Yorkie bars and York peppermint patty are named after cities where they were manufactured – York, England and York, Pennsylvania. Of course York, England was founded by the Romans in 71AD, but its namesake in Pennsylvania as recent as 1741.
The Yorkie bar was launched by Rowntree’s, a firm founded in 1862, whilst Hershey did not start making chocolate until 1903.
It’s an absolute travesty if ever there was one.
