UPDATE: 5/15/08 ... SAN FRANCISCO - The California Supreme Court has overturned a ban on gay marriage, paving the way for California to become the second state where gay and lesbian residents can marry. The justices released the 4-3 decision Thursday, saying that domestic partnerships are not a good enough substitute for marriage in an opinion written by Chief Justice Ron George.
"Under these circumstances, we cannot find that retention of the traditional definition of marriage constitutes a compelling state interest," the court said in a majority decision.
"Accordingly, we conclude that to the extent the current California statutory provisions limit marriage to opposite-sex couples, these statutes are unconstitutional."
The cases were brought by the city of San Francisco, two dozen gay and lesbian couples, Equality California and another gay rights group in March 2004 after the court halted San Francisco's monthlong same-sex wedding march, which took place at Mayor Gavin Newsom's direction. UPDATE: 3/14/05 ... SAN FRANCISCO (AP) - A judge ruled Monday that California's ban on gay marriage is unconstitutional - a legal milestone that, if upheld on appeal, would open the way for the most populous state to follow Massachusetts in allowing same-sex couples to wed.Judge Richard Kramer of San Francisco County's trial-level Superior Court likened the ban to laws requiring racial segregation in schools, and said there appears to be "no rational purpose" for denying marriage to gay couples. - by Lisa Leff (AP)complete AP article

On 3/11/2004, the California Supreme Court agreed to hear the same-sex marriage certificate case. Until the case is heard, the Court has stayed any further issuance of same-sex marriage certificates by the City and County of San Francisco.

On "Meet The Press" 2/22/04, the Governor of California stated, in reference to the San Francisco same sex marriage situation:(un-edited)

"Then it got to be a bigger issue and a bigger issue, and then yesterday, when I was in San Francisco for the Republican convention, all of a sudden we see riots and we see protests and we see people clashing. The next thing we know is there are injured or there are dead people, and we don't want to have that."-NBC News-Meet the Press-Feb 22, 2004

We have been at City Hall every day since this situation began. For what it's worth, the only "clash" that occured was when about 25 protestors attempted to block the Registrar's office. The SFPD handled that quickly, and peacefully. Beyond that, we have seen nothing but peaceful demonstration, by both sides, during our days (and nights) at SF City Hall. ... No riots. Peaceful and orderly protests, other than that one minor incident. No clashes. No problem. And finally, and most telling, ...the Governor was interviewed on Sunday, 2/22/04. His mention of "yesterday" means he was referring to Saturday, 2/21/04. City Hall was closed all weekend. There were no demonstrations of any kind on Saturday, not to mention "riots" or "clashes".
